These terms govern the use of our cloud and server services. Please read them carefully.
1. Scope
These terms apply to all contracts for the provision of cloud infrastructure, server solutions, and related services by ConstantServer GmbH.
2. Subject of the Contract
We provide you with virtual or dedicated server capacities, storage space, and network resources. The exact scope is specified in the respective service description during the ordering process.
3. Customer Obligations
You are responsible for the security of your access data. The use of our services for illegal activities, particularly hacking, malware distribution, or fraud, is prohibited.
4. Limitation of Liability
We are liable without limitation only for intent and gross negligence. For slight negligence, we are liable only for breach of essential contractual obligations, limited to the typical, foreseeable contractual damage.
5. Termination
The contract may be terminated by either party with a notice period of 14 days to the end of the month. Immediate termination is possible in the event of serious breaches of duty.
6. Changes
We reserve the right to change these terms with reasonable prior notice. If you do not object within six weeks, the new terms will be deemed accepted.
7. Governing Law and Jurisdiction
Austrian law applies. The place of jurisdiction for all disputes is our registered office in Vienna. Consumers may also invoke their general place of jurisdiction.
